Just to keep everyone updated on the 1001 nights oud story....

I haven't heard from Awad yet. I have however spoken to a lawyer and it seems I have a good case if I want to take Ahmed to the small claims court. It's all quite feasable, especially since I have found out it doesn't involve a lot of cost and the system apparently works quite well.

Now, I have written to Mike asking him if it would be ok to use the information I have received from you all about the fact that the oud is not new, in court, if it ever came to it. he said it would be fine. Would this be alright with everyone else? It would be great for me of course, because it would save me I think having to try and involve ustad Munshid in the whole thing. I would completely understand if people felt uncomfortable with this though. Please let me know if you have any reservations.

And just to reiterate. Is there in your opinion as people who know about ouds and the oud world, any way that Fawzi Munshid would have built an oud in 2007, but put a label for 2002 in it? In fact would he put an oud together out of second hand bits? (I'm only asking because this is what Ahmed implied at one point in our email correspondence, he said the oud maker had used an old face) And would he supply it with old strings on it? I myself don't think so. I just can't imagine it. But if there was, then I suppose I would have to try and contact Fawzi Munshid after all.


Having said all this, I think I need from my point of view to make something clear. I was quite shocked, when I realised after you all wrote back, that I really could do some serious damage to Ahmed's reputation. I don't wish anyone harm, and that includes Ahmed. Really, I just want my money back, and if Ahmed should accept to do this, I would take it as a gesture of good will, and I would be prepared to put the whole matter to bed. I have been really encouraged by you all though, to ask for what is my right, and this is what I will do.

So I will, unless I hear from Awad soon.. Awad have you heard from Ahmed?...take the necessary steps to go the legal system way.

I think it should be wise now by Muhktar to be very careful what he says and write to you.
Now he is spreading lies about Fawzy Munshid and Mukhtar can be safe in his London flat when he knows Munshid can defence himself....

Take this cartoon figure to the court Anne-Marie and don't care a dame about his so-called reputation.

It was quite clear from your photos that the oud was not new.

If for some reason (extremely unlikely) Mounshid had sold an old or refurbished oud as new, I would think (though I admittedly know nothing about the british legal system) that it would be Muktar's responsibility to show that, rather than yours. Since Muktar was acting as an agent to procure you a new oud, he failed to supply what he promised. He can be presumed to have a degree of expertise here, and so can't claim ignorance as a seller.
I'm fine with being cited if necessary.

Crack on Anne Marie, good luck to you, use any reply of mine if it helps. Theres just one thing I would like to say. If I were Munshid I would rather know about this than hear it from someone else, I would feel both flattered and disgusted and request all information, offer my assistance and provide a statement. My apologies for taking this long to provide a feedback regarding my recent correspondence with Mr. A. Mukhtar as a gesture of good will to resolve this issue, believe me Anne I do feel as same as you do and I would go to any length to get justice but the betrayal will remain for a long time.

As I previously volunteered to get to the bottom of this issue, I am sorry to say I failed to get any reply to my email. To be frank this is what I'd thought was the best thing to get the other party's point of view and reach a resolution but sadly It doesn't seem to be the case, therefore I wish you all the best in your quest for justice.

I am attaching a copy of the email sent to Mr. A. Mukhtar, a slight editing was made as the rest of the message was irrelevant to the main issue, also you will come across an Arabic word "akhi" which means my brother.

I do apologize to have contacted you this time regarding an issue been raised on one of the best global oud forums accessed by people from all over the world, I am a member of this oud community and am very proud to be part of.
Currently there is an issue with a (Fawzi Munshid) oud purchase regarding one of your students whom you helped acquiring the instrument. There are problems with the oud realised from the start, there is a discussion open now on the forum and many opinions raised and some are very harsh, and I think its damaging to your reputation in light of what’s been said. So to be fair to you I don’t want to be judgemental at this point as I think its not the full story as it appear to be from one side. So I would like to hear your feedback on this so we can clear the smoke and to limit the effects of this on your reputation and good character.
My only intention akhi is to defuse the situation and let everyone hear your side of story and hopefully come out with a solution that limits the effects and makes everyone happy. As I said this forums are viewed across the globe.
I am attaching the address, I hope you have a look (you can request a membership from the admin) and join the discussion, or at least you will have an idea.

Hello everyone

One of my tasks one of these days will be to figure out how to insert one of these smiley faces, but for now, you'll just have to imagine me smiling.

I must thank Awad also for spending all that time to write such a long email to Ahmed. Shame he hasn't replied...yet
